Terms of Cooperation

PHOTOSHOOT TERMS & CONDITIONS AND CLIENT COOPERATION POLICY

§1. General provisions

  1. These Terms & Conditions set out the rules for providing photography services by the Photographer and the rules of cooperation with the Client.

  2. Booking a photoshoot date (by email, form, social media, or phone) constitutes acceptance of these Terms & Conditions.

  3. These Terms & Conditions apply to photoshoots carried out in a studio and outdoors, including portrait and nude sessions.

  4. Individual arrangements (e.g., package, number of photos, price, date, additional services) may be set out in an offer, email message, or pro forma invoice and form an integral part of the arrangements.

 

§2. Booking and session organization

  1. A session date is deemed booked once the date and scope of the service/package have been agreed and the deposit has been paid (in accordance with §3).

  2. The Photographer books the studio in their own name, and the studio fee is added to the price of the service and itemized in the settlement (e.g., offer, pro forma invoice, invoice).

  3. The Client undertakes to arrive on time. If the Client is late, the session time is shortened by the amount of the delay, without any reduction in the price, unless the parties agree otherwise.

  4. The Client is liable for any damage caused by them or their accompanying persons, including damage to the studio and equipment.

 

§3. Fee, deposit and payments

  1. The fee for the service results from the price list, offer, or individual arrangements.

  2. Booking a session date requires payment of a deposit in the amount of 50% of the service price.

  3. The deposit is payable no later than 4 business days before the session, unless the pro forma invoice states otherwise.

  4. The remaining 50% of the price is payable on the day of the session, before the service begins.

  5. Failure to pay the deposit on time entitles the Photographer to cancel the booking.

  6. The Photographer issues an invoice for the service no later than 5 business days after the service is performed.

§4. Rescheduling and cancellation

  1. The Client may request to reschedule the session no later than 4 days before the scheduled session. Rescheduling is subject to availability.

  2. A reschedule requested within the time limit referred to in section 1 transfers the paid deposit to the new date, subject to sections 4–6.

  3. A reschedule request submitted later than 4 days before the scheduled session is treated as a cancellation as referred to in section 6, unless the Photographer agrees to a different settlement.

  4. If the studio booking has already been paid for or is non-refundable, and the studio does not allow changes without costs, the Photographer is entitled to deduct the studio cost from the amounts paid—according to the costs actually incurred.

  5. If the Photographer has incurred additional justified preparation costs (e.g., props, third-party services), such costs may be deducted, provided they were incurred in connection with the given booking.

  6. Cancellation by the Client:

    1. as a rule results in a refund of the deposit reduced by the costs actually incurred by the Photographer in connection with the booking (in particular the studio cost, if non-refundable),

    2. if the cancellation occurs later than 4 days before the scheduled session, the Photographer is entitled to retain the deposit in full as compensation for blocking the date and preparation costs, in particular studio costs and other costs referred to in sections 4–5, unless the parties agree otherwise.

  7. If the Client does not appear for the session or is late to the extent that the session cannot be carried out in any practical scope (e.g., only marginal time remains), it is deemed that the Client cancelled on the day of the session, and the deposit is non-refundable.

  8. In the event of unforeseen circumstances preventing the session from being carried out on the Photographer’s side (e.g., sudden illness, force majeure events), the Photographer will propose a new date; if agreeing a new date is not possible, the Photographer will refund the payments received, unless the parties agree otherwise.

  9. As a rule, the Client is entitled to a 14-day right of withdrawal, unless a statutory exception applies.

  10. Information and notices in this respect, including any exceptions and a model withdrawal form, are provided to the Client in a separate document (e.g., by email) and are also available on the Photographer’s website at: https://www.znamionkiewicz.com/terms.

§5. Session conduct, communication and cooperation rules

  1. During the session, mutual respect, personal culture, and respect for boundaries apply.

  2. During the session, the parties communicate on a first-name basis (“you/tu”), unless the Client requests formal communication prior to the session.

  3. The Client undertakes to follow the Photographer’s guidance regarding positioning, lighting, poses, and safety.

  4. The Client may not interfere with the technical settings of the equipment without the Photographer’s consent.

  5. The presence of an accompanying person must be reported before the session. The Photographer may refuse the presence of an accompanying person if it affects comfort, safety, or the nature of the session.

  6. For nude sessions and sessions of an intimate nature, enhanced ethical and safety rules apply.

  7. The following are prohibited: innuendo, sexually suggestive comments, proposals unrelated to the session, persuading the other party to perform actions not agreed prior to the session, forcing physical contact, or violating boundaries—towards the Photographer or the Client.

  8. Any change to the scope of the session (e.g., level of nudity, type of shots) requires the Client’s explicit consent. Lack of consent is binding and does not require justification.

  9. Touch (e.g., adjusting a pose, arranging hands, hair, or clothing) is permitted only after prior agreement and the Client’s explicit consent.

  10. The Client may at any time report discomfort, take a break, limit the scope of shots, or end the session.

  11. The Photographer may immediately terminate the session in the event of:

    1. breach of ethical or safety rules,

    2. violation of personal boundaries, including attempting to force touch or actions not agreed,

    3. aggressive, vulgar, humiliating behavior, or behavior posing a threat,

    4. gross obstruction of the performance of the service.

  12. If the session is terminated for reasons attributable to the Client:

  13. amounts paid are non-refundable, and the Photographer retains the right to the fee and reimbursement of incurred costs (including the studio fee),

  14. the Client is not entitled to demand that the session be performed on another date under the same payment.

  15. The Photographer may, if deemed appropriate, document the circumstances of the termination in the form of a note for evidentiary purposes.

§6. Photo selection, choice and editing

  1. After the session, the Photographer makes an initial selection of photos and provides the Client with material to choose from in an agreed form.

  2. Within the package, the Client selects the number of photos specified in the offer for final editing; in the basic package this is 5 photos, unless the offer states otherwise.

  3. Each additional photo beyond the package limit is charged extra; the unit price is agreed individually.

  4. Editing includes standard processing consistent with the Photographer’s style. Non-standard retouching (e.g., advanced photomontage, extensive body reshaping) requires separate arrangements.

  5. RAW files are not provided, unless the parties agree otherwise in writing.

  6. Final material is delivered digitally (e.g., via a download link). The delivery time is agreed individually or results from the offer.

  7. The Client may report justified technical issues with the material (e.g., a corrupted file) within a reasonable time after receiving it.

§7. Copyright, license and publication of the Client’s likeness

  1. The Photographer retains the economic (property) copyrights to the photos taken.

  2. The Client receives a non-exclusive license for private use (e.g., posting on social media, prints), without the right to resell, sublicense, or use commercially, unless the parties agree on a commercial license.

  3. Publication of the photos by the Photographer (portfolio, website, social media, contests) requires the Client’s separate consent, in particular for nude or sensitive images.

§8. Personal data protection (GDPR/RODO)

  1. The Client’s personal data is processed for the purposes of performing the agreement, communication, and settlements.

§9. Final provisions

  1. Matters not regulated by these Terms & Conditions are governed by Polish law.

  2. These Terms & Conditions may be updated. For any booking, the version in force on the booking date applies, unless the parties agree otherwise.

REGULAMIN SESJI ZDJĘCIOWYCH I WSPÓŁPRACY Z KLIENTEM

§1. Postanowienia ogólne

  1. Niniejszy Regulamin określa zasady świadczenia usług fotograficznych przez Fotografa oraz zasady współpracy z Klientem.

  2. Złożenie rezerwacji terminu sesji (mailowo, przez formularz, social media lub telefonicznie) oznacza akceptację Regulaminu.

  3. Regulamin ma zastosowanie do sesji wykonywanych w studio oraz w plenerze, w tym do sesji portretowych i aktowych.

  4. Ustalenia indywidualne (np. pakiet, liczba zdjęć, cena, termin, dodatkowe usługi) mogą być wskazane w ofercie, wiadomości mailowej lub dokumencie proforma i stanowią integralną część uzgodnień.

§2. Rezerwacja terminu i organizacja sesji

  1. Termin sesji uznaje się za zarezerwowany po uzgodnieniu terminu i zakresu usługi/pakietu oraz opłaceniu zaliczki (zgodnie z §3).

  2. Fotograf rezerwuje studio we własnym imieniu, a koszt studia jest doliczony do ceny usługi i wyszczególniony w rozliczeniu (np. oferta, proforma, faktura).

  3. Klient zobowiązuje się do punktualnego stawienia się na sesji. Spóźnienie Klienta skraca czas sesji o czas spóźnienia, bez obniżenia ceny usługi, o ile strony nie uzgodnią inaczej.

  4. Klient ponosi odpowiedzialność za szkody wyrządzone przez siebie lub osoby mu towarzyszące, w tym szkody w studio oraz sprzęcie.

§3. Wynagrodzenie, zaliczka i płatności

  1. Wynagrodzenie za usługę wynika z cennika, oferty lub ustaleń indywidualnych.

  2. Warunkiem rezerwacji terminu jest wpłata zaliczki w wysokości 50% ceny usługi.

  3. Zaliczka jest płatna najpóźniej do 4 dni roboczych przed sesją, chyba że dokument proforma wskazuje inaczej.

  4. Pozostałe 50% ceny jest płatne w dniu sesji, przed rozpoczęciem wykonywania usługi.

  5. Brak terminowej wpłaty zaliczki uprawnia Fotografa do anulowania rezerwacji terminu.

  6. Fotograf wystawia fakturę za usługę najpóźniej w ciągu 5 dni roboczych od wykonania usługi.

§4. Zmiana terminu i rezygnacja

  1. Klient może wnioskować o zmianę terminu sesji nie później niż 4 dni przed planowaną sesją. Zmiana jest możliwa w miarę dostępności terminów.

  2. Zmiana terminu dokonana w terminie, o którym mowa w ust. 1, obejmuje przeniesienie wpłaconej zaliczki na nowy termin, z zastrzeżeniem ust. 4–6.

  3. Wniosek o zmianę terminu zgłoszony później niż 4 dni przed planowaną sesją traktowany jest jak rezygnacja, o której mowa w ust. 6, chyba że Fotograf wyrazi zgodę na inne rozliczenie.

  4. Jeżeli rezerwacja studia została już opłacona lub jest bezzwrotna, a studio nie umożliwia zmiany rezerwacji bez kosztów, Fotograf jest uprawniony do potrącenia kosztu studia z wpłaconych kwot – zgodnie z faktycznie poniesionymi kosztami.

  5. Jeżeli Fotograf poniósł dodatkowe, uzasadnione koszty przygotowania (np. rekwizyty, usługi osób trzecich), koszty te mogą podlegać potrąceniu, o ile zostały poniesione w związku z daną rezerwacją.

  6. Rezygnacja Klienta z sesji:

    1. co do zasady skutkuje zwrotem zaliczki pomniejszonym o koszty faktycznie poniesione przez Fotografa w związku z rezerwacją (w szczególności koszt studia, jeżeli jest bezzwrotny),

    2. gdy rezygnacja następuje później niż 4 dni przed planowaną sesją – Fotograf ma prawo zatrzymać zaliczkę w całości jako rekompensatę za blokadę terminu i koszty przygotowania, w szczególności koszty studia oraz inne koszty, o których mowa w ust. 4–5, chyba że strony uzgodnią inaczej.

  7. W przypadku niepojawienia się Klienta na sesji lub spóźnienia uniemożliwiającego realizację sesji w praktycznym zakresie (np. pozostaje marginalny czas) uznaje się, że Klient zrezygnował w dniu sesji, a zaliczka nie podlega zwrotowi.

  8. W razie sytuacji losowych uniemożliwiających realizację sesji po stronie Fotografa (np. nagła choroba, zdarzenia losowe), Fotograf zaproponuje nowy termin; jeśli uzgodnienie terminu nie będzie możliwe – zwraca Klientowi otrzymane płatności, chyba że strony uzgodnią inaczej.

  9. Klientowi co do zasady przysługuje prawo odstąpienia w terminie 14 dni, chyba że zastosowanie ma ustawowy wyjątek.

  10. Informacje i pouczenia w tym zakresie, w tym ewentualne wyjątki oraz wzór oświadczenia o odstąpieniu, są przekazywane Klientowi w odrębnym dokumencie (np. mailowo) oraz udostępnione na stronie internetowej  https://www.znamionkiewicz.com/terms.

 

§5. Przebieg sesji, komunikacja i zasady współpracy

  1. Podczas sesji obowiązują zasady wzajemnego szacunku, kultury osobistej i poszanowania granic.

  2. Podczas sesji strony komunikują się na „Ty”, chyba że Klient przed sesją zgłosi preferencję komunikacji formalnej.

  3. Klient zobowiązuje się stosować do wskazówek Fotografa w zakresie ustawienia, światła, póz i bezpieczeństwa.

  4. Klient nie ingeruje w ustawienia techniczne sprzętu bez zgody Fotografa.

  5. Obecność osoby towarzyszącej wymaga zgłoszenia przed sesją. Fotograf może odmówić obecności osoby towarzyszącej, jeżeli wpływa to na komfort pracy, bezpieczeństwo lub charakter sesji.

  6. W przypadku sesji aktowych oraz sesji o charakterze intymnym obowiązują podwyższone zasady etyki i bezpieczeństwa.

  7. Zabronione są: podteksty, komentarze o charakterze seksualnym, propozycje niezwiązane z sesją, nakłanianie do czynności nieustalonych przed sesją, wymuszanie dotyku, naruszanie granic – wobec Fotografa lub Klienta.

  8. Każda zmiana zakresu sesji (np. poziomu nagości, rodzaju ujęć) wymaga jednoznacznej zgody Klienta. Brak zgody jest wiążący i nie wymaga uzasadnienia.

  9. Dotyk (np. korekta pozy, ułożenia dłoni, włosów, elementów garderoby) jest dopuszczalny wyłącznie po uprzednim uzgodnieniu i jednoznacznej zgodzie Klienta.

  10. Klient ma prawo w każdym momencie zgłosić dyskomfort, zrobić przerwę, ograniczyć zakres ujęć lub zakończyć sesję.

  11. Fotograf ma prawo przerwać sesję ze skutkiem natychmiastowym w przypadku:

    1. naruszenia zasad etyki lub bezpieczeństwa,

    2. naruszenia granic osobistych, w tym próby wymuszenia dotyku lub czynności nieuzgodnionych,

    3. zachowań agresywnych, wulgarnych, upokarzających lub stwarzających zagrożenie,

    4. rażącego utrudniania realizacji usługi.

  12. W przypadku przerwania sesji z przyczyn leżących po stronie Klienta:

  13. uiszczone kwoty nie podlegają zwrotowi, a Fotograf zachowuje prawo do wynagrodzenia i pokrycia poniesionych kosztów (w tym kosztu studia),

  14. Klient nie nabywa prawa do żądania wykonania sesji w innym terminie w ramach tej samej płatności.

  15. Fotograf może, jeśli uzna to za zasadne, udokumentować okoliczności przerwania sesji w formie notatki dla celów dowodowych.

§6. Selekcja zdjęć, wybór i obróbka

  1. Po sesji Fotograf dokonuje wstępnej selekcji zdjęć i udostępnia Klientowi materiał do wyboru w uzgodnionej formie.

  2. W ramach pakietu Klient wybiera określoną w ofercie liczbę zdjęć do finalnej obróbki; w pakiecie podstawowym jest to 5 zdjęć, o ile oferta nie stanowi inaczej.

  3. Każde kolejne zdjęcie ponad limit pakietu jest dodatkowo płatne; cena jednostkowa ustalana jest indywidualnie.

  4. Zakres obróbki obejmuje standardową obróbkę zgodną ze stylem Fotografa. Niestandardowe retusze (np. zaawansowane fotomontaże, rozległe zmiany sylwetki) wymagają odrębnych ustaleń.

  5. Pliki RAW nie są przekazywane, chyba że strony uzgodnią inaczej na piśmie.

  6. Materiał finalny przekazywany jest w formie cyfrowej (np. link do pobrania). Termin realizacji jest uzgadniany indywidualnie lub wynika z oferty.

  7. Klient może zgłosić uzasadnione uwagi techniczne do materiału (np. uszkodzenie pliku) w rozsądnym terminie od jego otrzymania.

 

§7. Prawa autorskie, licencja i publikacja wizerunku

  1. Fotograf zachowuje autorskie prawa majątkowe do wykonanych zdjęć.

  2. Klient otrzymuje niewyłączną licencję do użytku prywatnego (np. publikacja w social media, wydruki), bez prawa do odsprzedaży, sublicencjonowania i komercyjnego wykorzystania, chyba że strony uzgodnią licencję komercyjną.

  3. Publikacja zdjęć przez Fotografa (portfolio, strona internetowa, social media, konkursy) wymaga odrębnej zgody Klienta, w szczególności w przypadku zdjęć aktowych lub wrażliwych.

 

§8. Ochrona danych osobowych (RODO)

  1. Dane osobowe Klienta są przetwarzane w celu realizacji umowy, kontaktu oraz rozliczeń.

  2. Szczegółowe informacje o przetwarzaniu danych stanowią odrębną klauzulę informacyjną RODO dostępną na stronie internetowej: https://www.znamionkiewicz.com/privacy.

 

§9. Postanowienia końcowe

  1. W sprawach nieuregulowanych Regulaminem zastosowanie mają przepisy prawa polskiego.

  2. Regulamin może być aktualizowany. Do rezerwacji zastosowanie ma wersja obowiązująca w dniu dokonania rezerwacji, o ile strony nie uzgodnią inaczej.
